The regulation applies to all commercial ships above 5000 GT, that are engaged in transporting passengers or cargo, irrespective of their flag.
It does not apply to:

• Warships & Naval Auxiliaries
• Fishing Vessels
• Wooden Ships of Primitive Build
• Offshore Ships
• Ships not propelled by mechanical means
• Ships owned and operated by Governments for non-commercial use
